RENTAL TERMS

The rental agreement that you agree upon booking on our website applies between you as a tenant and the homeowner. Casa del Sol by Media Distribution Costa Blanca SL, CIF: B53153771 is only an intermediary.

Liability:

These rental terms apply between the tenant and the property owner. Casa del Sol is only the broker of the agreement. All additions to the booking are only valid if it is in written form.

The person booking must be at least 21 years old at the day of arrival.

Price:

All prices are presented in Euro. Casa del Sol will send a confirmation of your booking and these rental terms when a booking is placed on the website and the first payment is received.

The payment is the confirmation of the rental terms by the tenant.

Payment:

25 % of total payment are due at time of booking. Remaining balance are due a minimum of 90 days before arrival. If a booking is done less than 90 days before the arrival date, the total rental cost must be paid upon booking.

Payment of the security deposit are made via paypal/me. The link and instructions on how to pay the security deposit are sent in the booking confirmation email from Casa del Sol. The deposit must be paid at least 7 days before the arrival date.

Delayed payment gives Casa del Sol the right to cancel the reservation. In case of unpaid part or final payment (regardless of cause), it is counted as a cancellation by the tenant's side and the rules for cancellation come into force.

Cancellation:

100 % of paid prepayments refundable when cancelled 90 days before arrival or earlier. 50 % of paid prepayments refundable when cancelled between 90 to 30 days before arrival or earlier. 0 % refundable if cancelled after 30 days. Prepayments of deposition are always refundable at 100 % when booking are cancelled.

The cancellation must be made in writing directly to Casa del Sol ether by direct email to booking@casadelsol.se or through the website www.casadelsol.se . Casa del Sol has the obligation to confirm the cancellation in writing via email. Within the same rental period and price, the booking tenant can place another person in their place. Casa del Sol accepts a name change for a fee of 50 €. Name change must be made in writing to Casa del Sol at least 1 week before arrival.

Deposit:

The deposit is a security for the homeowner and Casa del Sol in case of any damage and defects that occur during the rental period. The sum of the deposit payment information are delivered in the confirmation email that are delivered upon the booking. Deposit charges apply when booking and are refunded 7 working days after the rental period. In the event of damage or sabotage caused by the tenant, this will be charged according to the value of the damaged or sabotaged. In the first instance, the amount is deducted from the deposit and if the damage exceeds the amount of the deposit, an invoice will be sent to the tenant. Electricity, gas, water possibly internet/wifi included in the rental period. (For long-term accommodation, electricity, gas, water and possibly internet/wifi will be added.)

Price changes:

Casa del Sol reserves the right to raise the rent correspondingly in the case of price increases, tax increases, fees, exchange rate changes.

Long-term rentals:

For bookings where the duration of the rental period is two months or longer, 2 months' rent minus the registration fee must be paid in at least 21 days prior to arrival. One month's rent is counted as a deposit and is refunded after the approved departure inspection to the account number stated at the time of booking. Remaining rents are paid monthly.

Long-term contract termination:

In the case of an ongoing lease that is longer than 75 days, a mutual notice period of 2 months applies. Both parties agree and agree that the rental term (this document) then takes the place as a seasonal rental contract.

The condition of the residence:

The property is always rented out in good condition. The owner is therefore obliged to carry out any repairs if necessary to preserve the apartment in the same good condition. The tenant is obliged to leave the residence in the same condition as when the rental period began. In case of defects, amounts are deducted from the deposit. All the properties presented on the website are for rent furnished and in existing condition. The contract includes bed linen and towels. The cost of final cleaning is always added. Casa del Sol's staff will during the final cleaning inventory and report any deficiencies and damages.

Complaints:

In case of any complaints concerning the residence and its condition, the tenant must present them as soon as possible after arrival. If anything breaks or malfunctions that occur during the stay must be reported immediately so that Casa del Sol or the owner have an opportunity to correct them.

The tenant is fully responsible for his/her actions but also for the persons who are staying in the residence during the entire rental period.

Casa del Sol does not take responsibility for the complaints that the tenant may have against the owner of the home, as Casa del Sol only acts as an intermediary

General rules of conduct:

Smoking indoors in all of the housing provided by Casa del Sol is not permitted.

Pets can only be accommodated in the homes where you have received an approval in advance. Casa del Sol or the homeowner cannot guarantee that there have been no pets in the accommodation previously or that the homeowner himself does not have pets. Casa del Sol is not responsible for the tenant's possible allergic reactions.

The holiday home and associated plot may only be occupied by the number of persons named at the time of booking, including children regardless of age. If more people live in the home than stated in the lease, Casa del sol or the landlord has the right to evict the extra persons. If the tenant has parked caravans/motorhomes/tents or the like on or beside the holiday home's plot, Casa del Sol or the homeowner has the right to reject the number of extra persons. If the tenant does not comply with such an instruction within 24 hours, Casa del Sol or the homeowner is entitled to cancel the lease agreement with immediate effect without further warnings. The cancellation means no refund of rental amount or deposit.

Any departure from the holiday home before the end of the rental period takes place at the tenant's own expense and risk. The tenant cannot cancel the lease or require a refund of the rental cost due to any reason.

During the rental period, the tenant can unexpectedly be exposed to noise or noise from eg. traffic, construction work or the like. Casa del Sol or the property owner cannot be held responsible for this.

When renting accommodation with access to the pool, the tenant must follow directions regarding private pool or area pool. The tenant is personally responsible for all activities by or in the pool. Children may only stay in the pool area under adult supervision.

Events beyond the ordinary:

For Force majure eg. war, nature and pollution catastrophe, epidemics, border closure, traffic conditions, interruptions in foreign exchange trading, strike or the like when the lease agreement cannot be implemented or can be made considerably more difficult, Casa del Sol can cancel the lease agreement. In such a situation, the homeowner or Casa del Sol cannot be held liable for any damage caused to the tenant.

Applicable law:

According to Spanish law (Ordinance 393/1974 of February 7 and Regulation INT / 1922/2003 of July 3), copies of all tenants' passports must be reported to Policia Local. (This agreement is governed by Spanish law (Ley 29/1994, de 24 de noviembre, de Arrendamientos Urbanos y por el Código Civil) The parties (Lessee and property owner) are therefore to submit to the courts where the rental property is located, and thus expressly waive any other applicable jurisdiction.
